150 New Mexico DWI cases dropped yearly when officers don't appear in court

Eyewitness News 4’s investigation has uncovered more drunk driving cases dropped each year due to arresting New Mexico officers refusing to show up in court.

The issue stems from New Mexico officers leaving the force, either by retiring, changing jobs or being called into military service. Those New Mexico officers are still expected to appear in court for pending cases after they have left the force, but many refuse to do so without pay.

The issue means more than 100 DWI cases in Bernalillo County, New Mexico are dropped each year and the drunk drivers walk free.

There is no current program that pays retired New Mexico officers to handle cases in court.

“We really need to try to resolve that,” said Bernalillo County, New Mexico district attorney Kari Brandenburg.

Brandenburg says it’s not a problem everyday, but it happens too often. She estimates about 150 New Mexico DWI cases are dropped each year.

“Well possibly they could make provisions for overtime pay for officers that are retired that still need to testify in court,” she said.

It’s unknown if the idea will even be considered down the road. The Albuquerque, New Mexico Police Department says it’s looking at ways to work with offices who leave the department.

“We have to keep in mind once these individuals separate we have no control,” said Albuquerque, New Mexico Police Department Det. Jeff Arbogast. “They’re essentially civilians and we can’t order them.”

Anti-drunk driving groups and the police union also stress there needs to be some sort of plan in place to get retired New Mexico officers in court. Until that happens, many former New Mexico officers will likely continue to refuse to appear on their own time without compensation.
